These Terms and Conditions together with my Privacy Policy govern your use of WiFi Helper Skill (the "Service") and your relationship with the owner of the Service, Emil Thies (Hufstr. 48, 47166 Duisburg, Germany) and its affiliates. By using this Service, you agree to be bound by these Terms and Conditions.
WiFi Helper Skill is a voice companion, integrating your (guest) WiFi Credentials, in one alexa application. The Service allows you to store and show those (guest) WiFi Credentials through your third party device. The connected third party device ("Device"), for example the Amazon Echo, is the component that you are adding to your WiFi Helper Skill. You can find details about the services contained in the App in our Privacy Policy.
Disruptions to the Service may occur as a result of force majeure, including strikes, lockouts and public agency orders, and also as a result of technical and other work that may need to be carried out on the systems of Strato (hosting Webserver and Databaseserver for this Service) or network operators in order to operate properly or improve the Services (e.g. maintenance, repair, software updates to systems, expansions). Disruptions to the Service may also result from temporary capacity shortages due to peaks in demand for the Service or from malfunctions in third-party telecommunications systems. Emil Thies will make every reasonable effort to rectify such disruptions without delay or to facilitate their rectification.
The customer can notify Emil Thies by email of any disruptions to the Service. Contact details are available in the “Contacts Section” of this document.
Emil Thies reserves the right to modify the scope of the Service as much as this modification is acceptable to the customer with respect to the overall scope of the Service.
The customer can terminate his or her use of the Service at each time by disconnecting the Service from the Device service. Emil Thies reserves the right to cease offering the Service at any time without prior notice.
By using the Service, you also agree to my Privacy Policy, which can be viewed via the Privacy Policy link.
Emil Thies shall assume no liability for the accuracy and topicality of the data and information transmitted via the Service. This shall also apply for the consequences of disturbances, interruptions and functional impairments of the Service.
In the event of minor negligence, Emil Thies shall only be liable for the violation of essential contractual duties (cardinal duties), such as those duties the contract is deemed to impose upon Emil Thies according to its spirit and purpose and the very performance of which is deemed to be necessary for a due and careful fulfilment of the contract and which may with good reason permanently be relied on by the customer. This liability is limited to the typical losses foreseeable at the time of concluding the contract.
The personal liability of the legal representatives, vicarious agents and employees of Emil Thies for any damage caused by their minor negligence shall similarly be limited by the extent described in the previous section.
The liability of Emil Thies shall remain unaffected in the event of any malicious concealment of a fault, on account of a guarantee or procurement risk being accepted and in accordance with product liability legislation. Limitations of liability shall not apply to willful intent, gross negligence or loss of life, physical injuries or damage to health.
Any link or function which provides access to third party programmes or content are provided for convenience only. Emil Thies does not express any opinion on or endorsement of the content of any such third party programmes and expressly disclaims any liability for the quality, content, nature, or reliability of any such third party resources and the information, products and services found thereon.
The customer must not use the Service for illegal purposes and shall not permit third parties to do so. The customer shall not be entitled to distribute or process commercially the data and information received within the context of his/her use of the Service. Emil Thies, in its sole discretion, may determine which uses of this Service are improper and/or unauthorized. Emil Thies may take any appropriate action in response to unauthorized uses of this Service, including but not limited to blocking any user of this Service.
Emil Thies owns the copyright in all material and information contained on this Service unless otherwise indicated. This Service and all materials and information herein are for informational purposes only and are subject to all applicable German and international copyright laws. Any reproduction, retransmission or other use is strictly prohibited, if not permitted by law. In particular, you must not use any part of the materials on the Service for commercial purposes without Emil Thies written permission.
Emil Thies is the owner of or licensed to use all intellectual property in the content of this Service and reserves the right to pursue any intellectual property infringement.
Emil Thies is not instructed, is not endsored and does not work on behalf of Strato or Amazon to provide this Service. All 3rd Party Companies are named to specify how the Skill works and is not advertising those companies.
The sole place of jurisdiction for all claims resulting from the business relationship with businesspeople is Duisburg.
The same place of jurisdiction shall apply if the customer does not maintain a general place of jurisdiction in Germany, moves his/her domicile or place of residence from Germany after conclusion of the contract, or if his/her domicile or place of residence is not known at the time when action is brought.
German law, excluding UN sales law, shall apply to any disputes arising from or in connection with this contractual relationship. This choice of law shall apply only to the extent that the mandatory, applicable consumer protection regulations of the state in which the consumer usually resides at the time of placing the order are not removed.
The owner of the Service is based in Germany. Emil Thies makes no representation that the Service is appropriate or available for use in other locations. If you access the Service from other locations, you are responsible for complying with local laws. By using the Service, you warrant that you are not located in any country, or exporting such software to any person or place, to which Germany has embargoed goods.
Although this Service and its content may be accessible worldwide, any product or service offered herein is void where prohibited by law. Accessing the Service from territories where its contents are illegal or unlawful is prohibited.
Emil Thies reserves the right to change these Terms and Conditions at any time. I will notify you of changes by publishing the amended Terms and Conditions on this page. Certain Terms and Conditions may be superseded by expressly designated legal notices or correspondence sent to you. Continued use of our Service after notification of any change in the Terms and Conditions indicates your consent to such changes. The date on which this policy was last revised is located at the top of this page.
If any of these Terms and Conditions should be determined to be illegal, invalid or otherwise unenforceable, then to the extent that Term or Condition is illegal, invalid or unenforceable, it shall be severed and deleted. The remaining Terms and Conditions shall survive, remain in full force and effect, and continue to be binding and enforceable. No waiver by Emil Thies of breach of an obligation arising under these Terms and Conditions shall constitute a waiver of any other breach.
